Marijuana Facilities 

On November 8, 2022, the voters of Missouri passed constitutional amendment 3, which allowed for the recreational use and associated land uses for Marijuana. Amendment 3 requires cities to permit recreational marijuana and its facilities within their municipal boundaries. 

On June 6, 2023 the City Council passed Ordinance #23-071 which regulates Medical and Recreational Marijuana Facilities and related activities to promote the health, safety, and general welfare of the citizens of the City of St. Charles, Missouri, and to establish reasonable and uniform regulations to prevent the possible deleterious operation, location, and concentration of Marijuana Facilities within the City of St. Charles, Missouri. 

Some of the regulations for operating a Marijuana Facility include the following:

  • Marijuana Facilities may be located in any of the following zoning districts: I-2 Heavy Industrial District, I-1 Light Industrial District, or C-3 Highway Business District. 
  • No Marijuana Facility shall be located more than 1000 feet from the centerlines of Interstate 70 or Interstate 370. 
  • No Marijuana Facility shall be located within 1000 feet of any public park or public pool. 
  • No Marijuana Facility shall be located within 1000 feet of any halfway house or correctional facility. 
  • No Marijuana Facility shall be located within 1000 feet of any other Marijuana Facility. 
  • No Marijuana Facility shall be located within any building or structure that contains a residential unit. 
  • It shall be unlawful for any person to distribute, transmit, give, dispense or otherwise provide Marijuana as a home occupation. 
  • A Marijuana Facility may be open 7 days a week, from 9:00AM – 7:00PM.
  • No Marijuana Facility shall be located within 1000 feet of a daycare as defined in Article 14 of the Missouri Constitution.*
  • No Marijuana Facility shall be located within 1000 feet of any educational institution or school as defined in Article 14 of the Missouri Constitution, or college or university, either public or private.*
  • No Marijuana Facility shall be located within 1000 feet of any church and defined in Article 14 of the Missouri Constitution.* 

*For these three (3) uses, the 1000 feet shall be measured in accordance with Article 14 of the Missouri Constitution. All other buffers shall be measured as the bird flies. Please consult with City Staff to confirm required buffers.
